 Using sudo and --public helps to a certain extend.
 I can now copy files from within the finder. But something strange
 happens.

 Only files with extended attributes are being copied. So when I would drag
 both IMG_0418.jpg and IMG_0419.jpg into the mounted encfs volume. Only
 IMG_0418.jpg would be copied...
