So I do not see an easier solution, but maybe you can think of one.
It is allowed but to be avoided if possible. The macfuse port does it
though for example. You should add this to the portfile:
{{{
destroot.violate_mtree yes
}}}
In fact, the ntfs-3g portfile has that line commented out.
