The license allows distribution:

$ ~/macports/base/portmgr/jobs/port_binary_distributable.tcl -v libgcc
"libgcc" is distributable

The license checks are only done on the server. MacPorts base doesn't know about licenses, and will check the server for the availability of a binary, if the other conditions are met.
