When you say "it was downloaded" do you mean you ran "sudo port sync"  
or "sudo port selfupdate" within 24 hours, or just that you ran "sudo  
port install" within 24 hours?

r49663 was committed on 2009-04-14 so if you synced or selfupdated  
anytime after that date you should have had the code in the portfile  
that prevents installation with Xcode < 3.1.
